General and Specific Conditions

OBJECT

These general and specific terms and conditions govern the rental of lockers owned by NEXSTATION SL through the website www.nextstation.com.es and via the touch screen located at: the commercial premises of the Avenida de América Interchange, Calle Avenida de América 9, (Level -1) 28002, Madrid, as well as their use. These terms and conditions also govern the contractual relationship between NEXSTATION, SL, the owner of the lockers, and the user who rents the locker service.

The parties will be referred to interchangeably as NEXTSTATION SL and End User or Customer

THE SERVICE

NEXTSTATION offers its Users the possibility of renting any of its lockers for periods of calendar days (within opening hours) FOR A PERIOD NOT EXCEEDING 48 H

What kind of slogans does NEXTSTATION offer?

NEXTSTATION offers 3 types of lockers:

  • Medium lockers (M), measuring 580mm x 436mm x 293mm. These lockers can hold approximately 1 cabin suitcase and a small backpack.
  • Large lockers (L), measuring 580mm x 436mm x 560mm. These lockers can hold approximately 2 cabin suitcases and a medium-sized backpack.
  • Extra-large (XL) lockers, measuring 580mm x 436mm x 856mm. These lockers can fit approximately 4 cabin suitcases, or one very large suitcase, or one large suitcase and one cabin suitcase.

What can a User enter in their locker?

Within the limits set out in this document (see, Section Limits on the use of lockers), a User may place as many items as they wish inside the rented locker or lockers.

How can a user know if there are free lockers at NEXSTATION?

You can find out by visiting the website www.nextstation.com.es and starting a reservation

For how long can a storage unit be rented?

The User may contract the locker rental service for a period of between 24 and 48 hours as a maximum limited time. The locker is located in a critical facility, therefore this period is recommended by the competent authority.

When will the User be able to access the storage unit(s) they have rented?

The rental service for each locker will be accessible during the hours indicated at the business premises, from Monday to Sunday, 365 days a year, from 5:30 AM to 1:00 AM. Outside of these hours, access to the lockers will not be possible, as the transport interchange where they are located will remain closed for security and maintenance reasons.

Once the User has inserted the bags, can they only access the locker again to remove them?

No, once the user has inserted their luggage, they can access the locker again as many times as they wish, but must always leave it closed and in the appropriate condition at the end of their reservation period.

What is the price that the User must pay per type of ticket/day?

1 Prices

The prices applicable per reservation are those indicated on the website and on the touch screen, including VAT, and refer to the rental of a storage unit (according to its size) per calendar day (from 6:00 am to 1:30 pm).

  • L 8 90 EU
  • XL 15 90 EU

The offers will be properly marked and identified as such, conveniently indicating the previous price and the offer price.

NEXSTATION reserves the right to make any modifications it deems appropriate to the website and physical store at any time and without prior notice, and may update products and services daily according to market conditions.

2. Payment method

Reservations can be made through any of the methods indicated on the website at the time of booking or on the touch screen located in the store itself. Specifically, by credit or debit card. ONLINE AND OFFLINE PAYMENTS

How are the lockers reserved and used?

The storage services offered through NEXTSTATION are fully automated.

Luggage storage reservations can be made through the website www.nextstation.com.es or physically via the on-site payment terminal.

The user will make this reservation online through our website www.nextstation.com.es, in the reservations section, selecting the number of lockers, size and rental period. For online reservations, you must also enter: name, surname, mobile phone number and email address

Once these Terms and Conditions have been accepted, payment has been made, and the booking has been completed, the User will receive confirmation of the booking, the number of the reserved locker(s), and their security code to access both the premises and their locker(s) via email and/or SMS on their mobile phone.

Therefore, the User will only be able to access their luggage through the security code provided via email and/or SMS sent to the phone number provided at the time of booking, or offline, on-site at the premises via POS reservation.

Access is granted via personal code

  • 8 2 The USER is responsible for the safekeeping of the access code or system
  • 8 3 NEXTSTATION “is not responsible” for unauthorized access due to user negligence

Once the booking number entered on the touch screen has been confirmed, the assigned locker will automatically open, allowing the User to deposit their luggage or other permitted items. The User must close the locker each time they open it, even when permanently removing their belongings.

What should the User do when they wish to finalize the booking?

When the User wants to open the locker for any reason, the system will ask via the touch screen located in the business premises if they wish to open it and continue the reservation (for example, because they have forgotten to remove or insert some item) or if they wish to open it to empty it and end the reservation

If the User wishes to end the reservation, they must select the option to open the locker to empty it and end the reservation. Once the locker has been emptied, they must close it so that another User can reserve it.

If the User selects the option to open the locker to empty it and end the reservation, the system will automatically unlock the locker so that it can be reserved by other Users.

If the User has left their belongings or any other items inside the locker, NEXTSTATION, SL will not be responsible for what the new User of the locker does with the belongings left by the previous User inside the locker.

What can the User do if they have any kind of problem using the ticket office?

In case of breakdown, lockout or any other type of TECHNICAL incident, provided it is during business hours, THE SYSTEM WILL DETECT AND RESOLVE IT, IT WILL AUTOMATICALLY RE-ARMON. FOR EXCEPTIONAL CASES WE PROVIDE THE CLIENT WITH AN ADDITIONAL PHYSICAL ASSISTANCE SERVICE IN CASES OF TRUE URGENCY AND NEED.

Can the User modify their reservation or cancel it?

Once the booking has been made and confirmed, the user will not be able to modify or cancel it.

Should the User wish to modify their booking once it has been made (change of dates or book more or fewer days than initially booked), they must cancel the booking and make a new one.

CANCELLATION AND REFUND POLICY

Cancellations and modifications by the User

Once the booking has been made and confirmed, the User may not modify or cancel it, and therefore no refund of the amount paid will be issued, except as provided in the following sections

Non-use of the service

The total or partial non-use of the service due to causes attributable to the User (including, without limitation, not showing up, not accessing the premises within the permitted hours, or not using the luggage storage during the reserved period) will not entitle the User to a refund, return or compensation

Technical issues attributable to NEXTSTATION

In the event of a technical incident that prevents the provision of the contracted service and that is attributable to NEXTSTATION, the User may request, as appropriate and after verification

  • the resumption of service
  • a change of slogan
  • the full or partial refund of the amount corresponding to the period not actually enjoyed

Application procedure

Requests related to cancellations, refunds, or incidents must be made in writing through the channels indicated by NEXTSTATION. The User must provide the booking number and the necessary identification details to the email address reembolsos@nextstation.com.es. NEXTSTATION may require additional information to verify the request.

Resolution period

NEXTSTATION will communicate the resolution of the request as soon as possible, taking into account the nature of the incident and the necessary checks.

ACCEPTANCE AND PROOF OF ACCEPTANCE

The service must be purchased through the website www.nextstation.com.es and implies full acceptance of each and every one of these General and Specific Conditions as displayed at that time in the link that appears on the website itself and on the touch screen, without any subsequent changes to the General Conditions being applicable.

From the moment of acceptance, the user acquires the status of NEXTSTATION Client as described in these General and Specific Conditions; any product or service offered subsequently by NEXTSTATION must be subject to a new contract

NEXSTATION informs you that it archives the electronic documents in which the purchases are formalized.

ACCESS AND RESERVATION

To rent NEXTSTATION lockers, the following requirements must be met:

  • To have reached or be over 16 years of age
  • Fill in the required information to complete the booking and payment
  • Accept these general terms and conditions for contracting the service and using the lockers

The User must save the code sent to the email address and/or mobile phone provided by the Customer, as it will be essential to enter the store, open the luggage storage and retrieve the luggage.

SERVICE TERMINATION

The service will end when the User selects the option on the touchscreen to open the locker and leave permanently. In this case, the User must remove all items from inside the locker and leave it closed and in the same condition.

If the User has left their belongings or any other items inside the locker, NEXSTATION SL will not be responsible for what the new User of the locker does with the belongings left by the previous User in the locker.

USER OBLIGATIONS LIMITS ON THE USE OF THE CONSENTS

By contracting NEXSTATION’s storage unit rental services, the User agrees, in particular and without limitation:

  • Use the lockers solely for the purpose of depositing your property that you need to keep temporarily in a safe place.
  • To use the lockers diligently and, in particular, to ensure that the locker is properly closed when the User leaves the premises (after inserting or removing the items). In the event that the User leaves their locker open with their belongings inside, NEXTSTAION, SL will not be responsible for their loss, theft or damage that may have been caused.
  • Not to use the instructions for illegal or unauthorized purposes. In particular, the User agrees not to store objects whose mere possession or trafficking is illegal (such as: stolen objects, drugs, pornographic materials or in any way, degrading to human beings, etc.)
  • Do not deposit any goods whose possession requires a license without said license or authorization (such as weapons)
  • Do not insert any type of material that is polluting or dangerous (such as flammable objects or hazardous substances) into the instructions.
  • Do not use the designated areas to deposit animals or any type of living or deceased being.
  • Do not place food in the lockers, unless it is packaged food that cannot spill, stain the lockers or produce any kind of odors in the NEXTSTATION premises.
  • Do not share your security code with third parties, being fully responsible for any breach of this obligation and its consequences. The reservation code is “personal and non-transferable” and can only be used by the reservation holder, and cannot be transferred to a third party when the reservation holder goes to collect their belongings from the business premises.
  • Do not use the lockers to deposit goods that must be collected by a third party. The lockers must not be used as a means of transferring goods between parties. This use is not authorized by NEXTSTATION.
  • The User may not remain in the premises longer than strictly necessary to access and remain there solely for the purpose of accessing the rented storage unit and only to carry out a specific action related to the inserted packages.
  • No eating or drinking inside the premises
  • To remove the packages placed in the rented lockers when your rental period ends
  • To leave the lockers, at the end of the service, in the same condition in which they were found and, in particular, to notify NEXSTATION via email of any incident that the User encounters in the use of the lockers or in their condition
  • Not to take photographs or videos inside NEXTSTATION premises (except for those necessary to capture the reservation/security number) and, in particular and without limitation, not to take photos or recordings of the premises’ security mechanisms
  • Do not include money, jewelry, technological items (EXCEPT tablets, computers, UNDER THE CLIENT/OWNER’S RESPONSIBILITY) or items of special value in the lockers, the user being solely and exclusively responsible for the decision to use the rented lockers to store such items of special value.
  • To pay the price of the storage with a credit/debit card in your name or with the authorization of the cardholder

CONSEQUENCES AND RESPONSIBILITY OF THE USER IN CASE OF FAILURE TO COMPLY WITH THEIR OBLIGATIONS

The User shall indemnify NEXTSTATION SL against any damages arising from the breach of its obligations under this contract, including those set forth in the preceding Clause, those specified in the remaining Clauses of this contract, and those arising therefrom.

Failure to comply with any of these Conditions may result in the withdrawal or cancellation of the Services by NEXTSTATION without prior notice to the Client and without giving rise to any right to compensation.

Furthermore, in the event of non-compliance with the rental period, non-compliance with the proper use of the lockers and damage caused to the lockers by the Users, the following will apply:

Breach of the rental period

If the User does not remove the items deposited in the lockers once the maximum rental period contracted (48 hours) has ended, the following rules will apply, depending on when the action takes place:

Situation after the termination of the lease

Once the maximum rental period has expired without the User having removed the luggage, the operator is authorized to open the storage unit for the sole purpose of freeing up the compartment, and may remove the luggage and transfer it to an internal operational management area.

This removal may be carried out by the establishment’s own staff or by authorized personnel, including cleaning staff, exclusively as operational support, without implying the assumption of a special custody obligation.

The operator assumes no obligation to store or preserve luggage beyond what is strictly necessary for the operational management of the service.

During the time strictly necessary for said management, the operator may retain the packages until full payment of the amounts owed, accruing, for each day elapsed from the expiration of the rental until the effective removal by the User, an amount equivalent to the daily price of the uncollected storage, without prejudice to the operator’s right to claim for the damages actually suffered.

Consideration of legal abandonment

Once the maximum rental period (48 hours) has elapsed without the User having removed the items and without having regularized their situation, said goods will be considered abandoned, in accordance with the provisions of article 460 of the Civil Code, without the need for prior request

From this moment on, the operator assumes no obligation whatsoever for safekeeping, custody, preservation, return or subsequent management of the goods

Fate of abandoned luggage

Goods considered abandoned may be disposed of as the operator deems appropriate, depending on their nature:

  • Items with no apparent value should be disposed of or deposited in designated containers
  • Deliver valuables to the appropriate Lost and Found service
  • Documentation or other sensitive items handed over to the exchange’s security services.

The operator may also donate, destroy or hand over such goods to the competent authorities, without any right to compensation for the User

Exclusion of shipments and claims

NEXTSTATION, SL will not manage, organize or act as an intermediary in any way for the shipment, return or transport of goods, even when the User offers to assume the costs arising from such actions, and will not assume any risk arising from transport.

The User expressly waives any claim related to the recovery, shipment or final destination of the goods considered abandoned, leaving NEXTSTATION, SL fully harmless against any liability arising therefrom

Failure to properly use the instructions

NEXTSTATION, SL reserves the right to remove any item that does not comply with the regulations for using the lockers and is a prohibited item. In such cases, NEXTSTATION, SL is authorized to call the police or competent authority and report the conduct, as well as to remove the prohibited items and dispose of them as it deems appropriate or convenient, without any liability to NEXTSTATION, SL.

The User will be responsible for the items they place in the lockers.

In any case, the removal of prohibited items will entail a penalty of 300 Euros, a penalty that will not exclude the obligation of the non-compliant User to compensate NEXTSTATION SL by giving it the disposal it deems appropriate or convenient, according to the type of goods abandoned, with full indemnification for NEXTSTATION SL for the damages and losses actually caused.

Damage caused to the lockers and/or premises by Users

The User will be fully responsible for any damage or deterioration that may be caused to the lockers due to improper or inadequate use and to the commercial premises. If necessary, the User must compensate NEXTSTATION SL for any physical damage caused to the locker(s) and/or the commercial premises, as well as for any lost profits.

In particular and without limitation, the User causing the damage shall pay NEXTSTATION SL a penalty of one day’s rental for each day the storage unit is unusable, which is set at 100 Euros per day, as well as the cost of repair or replacement, which in the case of replacement is quantified at 1,000 Euros, the foregoing without prejudice to any damages that may be proven if they are greater.

Any damage that the User may cause to the premises through improper or inappropriate use will be penalized with a minimum of 400 Euros, and this amount may be increased to the amount that NEXTSTATION SL can justify for the damages.

Payment of penalties

The penalties detailed in this section will be paid by the User using the same payment method used by the User when contracting the service or by bank transfer to the account indicated by NEXTSTATION, SL if required by the User

The User expressly accepts that NEXTSTATION, SL may collect the amounts established in this section using the User’s card or payment method when contracting the service and may present the User, if required, with details of the expenses incurred and the penalties applied.

NEXTSTATION, SL OBLIGATIONS

NEXTSTATION SL undertakes to keep the lockers service active and to make available to the User, during the contracted time, the locker or lockers that the User has contracted in good working order

Furthermore, NEXTSTATION SL undertakes to resolve any issues that may arise in the use of the lockers as soon as possible.

LIMITATION OF LIABILITY OF NEXTSTATION SL

NEXTSTATION SL offers a storage space rental service, but is not responsible for the safekeeping of the items. The User is solely responsible for the goods they place in the rented storage units.

The User, if necessary, must file a complaint with the competent authorities in case of theft, loss or damage to the packages stored for any reason

NEXTSTATION offers a 24-hour video surveillance service, 365 days a year, which the User expressly accepts. Therefore, should the competent authorities require the aforementioned recording, it will be sent to them as soon as possible by NEXTSTATION SL.

NON-APPLICATION OF THESE GENERAL AND SPECIFIC CONTRACTUAL CONDITIONS

Users who have not booked their locker through the means offered by NEXTSTATION, SL (website or at the business premises, using the software provided for this purpose) will not be considered Clients of NEXTSTATION, SL and therefore these General and Specific Terms and Conditions of the contract will not apply to them.

In particular, the following will not be considered Clients of NEXTSTATION, SL:

  • Those who accept the booking code provided by another user, either because that user is leaving the locker or to share it.
  • Those who leave their luggage in an open locker without prior reservation and do not call NEXTSTATION, SL to try to resolve this error
  • Those who leave their luggage outside the lockers provided for that purpose
  • Those persons who are in the premises for purposes other than to reserve a locker and use it

CLAIMS

Should the User believe they have grounds to file a complaint, they may do so by sending an email to the following email address : contacta@nextstation.com.es

At NEXTSTATION, SL we will try to resolve the incident and find a satisfactory solution for all parties.

If the User is not satisfied with the response from NEXTSTATION, SL, they have the option of submitting a complaint form to the consumer authorities of the Community of Madrid. The corresponding form can be obtained through the following link:

LANGUAGE

The language in which the contract between NEXTSTATION, SL and the Client will be finalized is Spanish, even if the Client has chosen any other available language on the touch screen to navigate it.

INDUSTRIAL AND INTELLECTUAL PROPERTY

The intellectual and industrial property rights to the works, trademarks, logos, and any other protectable content on the website and in the business premises of NEXTSTATION, SL belong exclusively to NEXTSTATION, SL or to third parties who have authorized their inclusion on the website and/or in the business premises

The unauthorized reproduction, distribution, marketing or transformation of such works, trademarks, logos, etc. constitutes an infringement of the intellectual and industrial property rights of NEXTSTATION, SL or the owner thereof, and may give rise to the exercise of any legal or extrajudicial actions that may correspond to them in the exercise of their rights

Furthermore, the information that the Customer can access through the website and the touch screen located in the business premises may be protected by industrial, intellectual or other property rights. NEXTSTATION, SL will not be liable in any case and under any circumstances for any infringements of such rights that the Customer may commit as a user.

DATA PROTECTION

Although the Privacy Policy is regulated in the “Privacy Policy” section of the website www.nextstation.com.es, the following is set out in these Terms and Conditions:

In accordance with Organic Law 3/2018 of December 5, on the Protection of Personal Data and Guarantee of Digital Rights (the “LOPD”), we inform you that NEXTSTATION SL will be responsible for processing the personal data you provide within the framework of Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD), solely for the management of the service

The personal data processed will be kept for as long as this contractual relationship between NEXTSTATION SL and the User is maintained, and subsequently will be kept, in a blocked state, for the time necessary to comply with any applicable legal obligations.

The legal basis for carrying out the aforementioned data processing is the execution and management of this contract

The name, surname, telephone number and email address provided by the User will be transferred to Drop Point Systems SLU to manage the booking

If your personal data also needs to be communicated to third-party providers, NEXTSTATION, SL will enter into the corresponding data processing agreement with said providers, in order to ensure that your personal data is processed by said third parties in accordance with the requirements and guarantees of the LOPD (Spanish Data Protection Law).

The User is also informed that the data processed through video surveillance will be processed for the purpose that motivated its installation, which is linked to ensuring the safety of people, property and facilities

The aforementioned recordings will be incorporated into files owned by NEXTSTATION, SL or authorized third parties for security purposes and for the legally established period and will only be transferred to the competent authorities (Judges, Courts or Security Forces) in case of request or for the defense of the rights of NEXTSTATION, SL or the Users

The User may exercise the following rights related to their personal data:

  • Access
  • Rectification
  • Suppression
  • Limitation of treatment
  • Data portability
  • Opposition

Complaint to the Spanish Data Protection Agency if deemed appropriate

JURISDICTION AND APPLICABLE LAW

In the event of any conflict or discrepancy in the interpretation or application of these contractual conditions, the Courts and Tribunals that will hear the matter will be those determined by the applicable legal regulations regarding competent jurisdiction, which, in the case of end consumers, refers to the place of performance of the obligation or the domicile of the buyer.

All of this is without prejudice to the Client’s right to appeal to the Consumer Arbitration Board in their district.

In the case of a sale made by a company, both parties submit to Spanish law and, expressly waiving any other jurisdiction, to the Courts and Tribunals of Madrid (Spain)
